Welcome to BLENDR. The terms “we,” “us,” and “our” refer to BLENDR.
BLENDR operates this store and website, including all related information, content, features, tools, products, and services provided through the website (collectively, the “Services”). BLENDR is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced in them, describe your rights and responsibilities when using the Services.
Please read these Terms carefully. They contain important information regarding your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms or our Privacy Policy, you should not use the Services.

By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you otherwise have legal authority to enter into these Terms.

If you create or use a customer account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
You may not sell, transfer, assign, or license your customer account to another person.

We make reasonable efforts to accurately display and describe our products, including product appearance, colors, shades, features, ingredients, quantities, and packaging.
However, colors and shades displayed on a screen may vary depending on your device, display settings, lighting conditions, skin tone, lip pigmentation, and other factors.
Individual results and product appearance may vary from person to person.
Nothing in this section limits any rights you may have under our Shade-Match Guarantee, as described in our Refund Policy.
Product descriptions, packaging, formulas, availability, and other product details may be updated from time to time.
We reserve the right to discontinue products or limit the quantities available for purchase where permitted by law.
BLENDR products should be used only as directed. If you experience irritation, discomfort, or another unwanted reaction, discontinue use and seek appropriate professional advice if necessary.
Section 3 — Orders
When you submit an order, you are making an offer to purchase products from BLENDR.
An order is not considered accepted until we confirm acceptance and successfully process the applicable payment.
We reserve the right, where permitted by law, to reject, limit, cancel, or modify an order for reasons including:
- Product or inventory availability.
- Suspected fraud or unauthorized transactions.
- Pricing or listing errors.
- Purchase limits.
- Suspected resale activity.
- Payment-processing issues.
- Other circumstances reasonably requiring cancellation.
If we cancel or materially modify an order after payment has been collected, we will issue any refund required for the affected portion of the order.
Please review your order carefully before submitting it. Once an order enters processing or fulfillment, we may be unable to change or cancel it.

Returns, replacements, refunds, and exchanges are governed by our Refund Policy.
Our Shade-Match Guarantee is also governed by the terms described in our Refund Policy.
Products purchased through BLENDR are intended primarily for personal or household use and not for unauthorized commercial resale.
Section 4 — Prices, Promotions, and Billing
Prices may change without notice.
The price charged for an order will generally be the price displayed and applicable at the time the order is submitted, subject to corrections permitted under these Terms and applicable law.
Unless otherwise stated, displayed product prices may not include:
- Sales tax or other applicable taxes.
- Shipping charges.
- Customs duties.
- Import fees.
- Other charges imposed by governmental or third-party authorities.
BLENDR may offer bundles, promotional pricing, discount codes, automatic discounts, affiliate promotions, limited-time offers, cart offers, and other promotions.
Each promotion may be subject to its own terms, including:
- Eligible products.
- Minimum purchase requirements.
- Usage limits.
- Expiration dates.
- Restrictions on combining discounts.
- Customer or geographic eligibility.
If specific promotional terms conflict with these Terms, the specific promotional terms will control with respect to that promotion.
Unless expressly stated otherwise, promotional offers have no cash value and cannot be redeemed for cash.
We reserve the right to modify, suspend, or discontinue promotions where permitted by law.
You agree to provide accurate and authorized payment information and agree to pay all charges associated with orders you submit.
Payment information may be processed by Shopify and other payment service providers.
Section 5 — Shipping and Delivery
Shipping and delivery timeframes displayed through the Services are estimates unless expressly stated otherwise.
We are not responsible for delays caused by circumstances outside our reasonable control, including:
- Shipping carriers.
- Severe weather.
- Natural disasters.
- Customs processing.
- Transportation disruptions.
- Incorrect or incomplete addresses provided by the customer.
- Governmental actions.
- Other events beyond our reasonable control.
Customers are responsible for providing a complete and accurate shipping address.
If you discover an address error, please contact us as soon as possible. We cannot guarantee that an address can be changed after an order has entered fulfillment.
Ownership and risk of loss for products will transfer in accordance with applicable law.
If your order arrives damaged, defective, or incorrect, please follow the procedures in our Refund Policy.
Section 6 — Returns, Refunds, and Shade-Match Guarantee
Returns and refunds are governed by our Refund Policy.
For hygiene and safety reasons, certain opened or used cosmetic products may not qualify for ordinary returns.
Eligible products may nevertheless be covered under our policies relating to damaged, defective, or incorrect products or under our Shade-Match Guarantee.
The Shade-Match Guarantee is a separate customer-service program and is subject to the eligibility requirements, limits, and procedures described in our Refund Policy.
BLENDR reserves the right to reject requests that we reasonably determine involve fraud, abuse, repeated misuse, or attempts to circumvent the terms of a promotion or guarantee.
Nothing in these Terms limits statutory consumer rights that cannot lawfully be waived or restricted.
Section 7 — Intellectual Property
The Services and their content, including BLENDR branding, trademarks, logos, product names, text, graphics, photographs, videos, audio, page designs, product descriptions, and other materials, are owned by BLENDR or used under appropriate licenses and may be protected by copyright, trademark, patent, trade dress, and other intellectual-property laws.
You may use the Services for personal, non-commercial purposes.
Except as permitted by law or authorized by us in writing, you may not reproduce, distribute, modify, republish, display, transmit, sell, exploit, or create derivative works from BLENDR-owned content.
Nothing in these Terms grants you any license or ownership interest in BLENDR intellectual property except the limited right to access and use the Services in accordance with these Terms.
BLENDR names, logos, product names, designs, and slogans may be trademarks or other protected intellectual property of BLENDR or its licensors.
Shopify's names, logos, trademarks, and other intellectual property remain the property of Shopify or its licensors.
Section 8 — Optional and Third-Party Tools
The Services may provide access to features, applications, integrations, tracking services, payment tools, social-media functionality, or other services operated by third parties.
We may not control or monitor those services.
Third-party tools may be governed by their own terms and privacy practices.
Your use of third-party tools is subject to the applicable third party's terms and policies.
To the fullest extent permitted by law, BLENDR is not responsible for third-party services that we do not control.
We may add, modify, or remove tools and features from the Services from time to time.
Section 9 — Third-Party Links
The Services may include links to websites or services operated by third parties.
BLENDR is not responsible for the content, accuracy, security, privacy practices, products, or services of third-party websites we do not control.
If you leave the Services and interact with another website or service, you do so subject to that provider's terms and policies.
Any complaints regarding a third party's products or services should generally be directed to that third party.
Section 10 — Relationship With Shopify
BLENDR is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make through our store are made directly with BLENDR.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and BLENDR, including any injury, damage, or loss resulting from products or services purchased from BLENDR.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to purchases and transactions made directly with BLENDR.
Section 11 — Privacy
Personal information collected through the Services is handled according to our Privacy Policy.
Certain personal information may also be processed by Shopify in accordance with Shopify's privacy policies.
Because the Services are hosted by Shopify, Shopify may collect and process information relating to your access to and use of the Services in order to operate, support, secure, and improve Shopify's services.

Section 12 — Reviews, Feedback, and User Content
If you submit reviews, photographs, videos, comments, testimonials, suggestions, ideas, or other content to BLENDR (“Feedback”), you represent that you have the right to provide that content.
Unless otherwise agreed in writing, you grant BLENDR a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, modify, adapt, and publish Feedback for purposes including operating, improving, advertising, and promoting BLENDR and the Services.
If you received compensation, free products, discounts, affiliate commissions, or another incentive relating to submitted Feedback, you are responsible for making disclosures required by applicable law.
You may not submit content that:
- Violates another person's intellectual-property or privacy rights.
- Is knowingly false or misleading.
- Is defamatory, unlawful, threatening, abusive, or obscene.
- Contains malicious software or harmful code.
- Misrepresents your identity or relationship with BLENDR.
We reserve the right, but are not obligated, to review, remove, or decline to publish user-submitted content where permitted by law.
Section 13 — Errors, Inaccuracies, and Omissions
Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to matters such as:

We may restrict or terminate access to the Services when we reasonably determine that these Terms have been violated.

If software, automated tools, bots, artificial-intelligence agents, or similar systems access the Services, such access must comply with these Terms, applicable technical restrictions, and applicable law.
We may restrict automated access, including through technical measures, where necessary to protect our Services, customers, intellectual property, systems, or commercial interests.
Automated systems may not circumvent security measures, CAPTCHAs, rate limits, access restrictions, or mechanisms intended to distinguish automated activity from human activity.

We may suspend or terminate access to the Services where permitted by law, including when we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, threatened the security of the Services, or abused BLENDR policies or promotions.
Termination does not eliminate payment obligations or other obligations that arose before termination.
Provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, privacy, disclaimers, limitations of liability, indemnification, governing law, and dispute-related matters.
Section 17 — Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis except where BLENDR expressly states otherwise.
We do not guarantee that:
- The Services will always be available or uninterrupted.
- Website content will always be error-free.
- Every product will produce identical results for every customer.
- Product color or appearance will appear identical across every screen, lighting condition, skin tone, or lip pigmentation.
TO THE FULLEST EXTENT PERMITTED BY LAW, BLENDR DISCLAIMS WARRANTIES THAT MAY OTHERWISE BE IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.
Nothing in this section eliminates rights or warranties that cannot legally be excluded.
Section 18 — Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLENDR AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
THIS MAY INCLUDE LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR SIMILAR DAMAGES.
THE ABOVE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.
SOME STATES, PROVINCES, COUNTRIES, OR OTHER JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, OUR LIABILITY WILL BE LIMITED ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
Section 19 — Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless BLENDR and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal expenses resulting from:
- Your material breach of these Terms.
- Your violation of applicable law.
- Your violation of another person's rights.
- Your unlawful or unauthorized use of the Services.
Your indemnification obligations will apply only to the extent enforceable under applicable law.
Section 20 — Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the extent necessary.
The remaining provisions will continue in full force and effect.
Section 21 — Waiver and Entire Agreement
Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with policies and terms incorporated by reference, constitute the agreement between you and BLENDR regarding your use of the Services and supersede prior agreements relating to the same subject matter.
Section 22 — Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent except where applicable law provides otherwise.
BLENDR may assign or transfer its rights and obligations in connection with a merger, reorganization, sale of assets, financing, or other business transaction, subject to applicable law.
Section 23 — Governing Law
These Terms and your use of the Services will be governed by the laws applicable in the jurisdiction where BLENDR is headquartered, without giving effect to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
Any legal proceedings relating to these Terms will be brought in courts having lawful jurisdiction over the dispute.
Nothing in this section limits any consumer right to bring proceedings in another jurisdiction where applicable law grants that right.

We may update these Terms periodically to reflect changes to our Services, products, policies, legal obligations, technology, or business practices.
The current version will be posted on this page.
When required by applicable law, we will provide notice of material changes.
